CASE RECALLS BiG CITY FIRE
The Covent Garden restaurant catastrophe of October 27, 1948, was recalled in the Supreme Court today by a damages claim. Alfreda May Jacobs, of Ballville street, Prospect, sued Ellis Cafes Ltd., of Gouger street, Adelaide, for unspecified damages over the death in the fire of her husband, Allan Hercules Jacobs, 55, a kitchenband. The restaurant had been unsafe because of a griller in a non-fireproof position, inflammable walls and ceiling, and failure to guard against danger, Mrs. Jacobs set out.
Assessment only
The company filed a defence denying liability and any breach of duty. When the case was called before Mr. Justice Reed, Mr. J. F. Brazel for Ellis Cafes Ltd., said liability would not be resisted, so the case came before the court for assessment only, Mr. K. L. Ward, QC, with Mr. R. W. Grubb appeared for the widow. Mr. Ward said Jacobs had been employed at Covent Garden for about four years, earning about £6/10/. Before that he had managed a small butcher shop at Prospect. A son, Stanley, now aged about 13½, had been awarded £950 workmen's compensation as a dependent. That clould not be taken into consideration in the present proceedings, Mr. Ward said. Mrs. Jacobs told the court she had been entirely dependent on ber husband's earnings.
Serious breakdown
He had been easy to get on with and their marriage had been a happy one. She had had a serious break down in health since his death. (In the fire five people lost their lives and five were in injured.) Judgment was reserved.
